Welcome to Seattle Web Development & Consulting, LLC's web hosting! We strive to provide the best web hosting service on the Internet. When you create an account with us, you agree to be bound by the following rules and conditions:

	Storage usage
	You will be limited to using the specified amount of storage for the plan you are signed up for. The system will allow a certain amount of overage. If you go over your limit, we will try and contact you to resolve the situation. If we cannot contact you within three (3) business days we will delete files to bring your usage within your quota.
	Bandwidth usage
	Your web plan will have a specified amount of data you may transfer per month. We calculate based on calendar months (which may not coincide with your billing period). We will not cut off your site if you go over your specified bandwidth, however we will follow this procedure:
	We will upgrade your plan to allow the amount of bandwidth you used. The price difference will show up next time you are billed. If you cancel your account after going over your bandwidth limit, we will charge you for the extra bandwidth used and close your account.
	Plan changes
	You may request at any time to upgrade/downgrade your plan. There is no cost to do so. We will not issue a refund for a plan downgrade or charge a pro-rated amount for a plan upgrade. You will simply start paying the new plan price on your next billing date.
	Illegal content
	We reserve the right to disable your web site if it is found to contain content deemed illegal by us. Any legal content is allowed.
	Availability of service
	We strive to provide the highest availability of our servers. However, we provide no warranty or guarantee as to the availability of our servers. If we experience excessive down time we will be limited in liability to the amount we billed you for service that month.
	Account cancellation
	We do not require contracts. You may cancel your account at any time. If you cancel your account, it will continue to be active until the end of the billing cycle. We will not issue refunds for mid-billing cycle cancellations.
	Misuse of system
	We will terminate your account if we detect any of the following activity from your account:
	ASP code meant to slow down the server. ASP code meant to attempt to read restricted files and/or create or overwrite files with malicious code. Any executable code uploaded with the purpose of executing malicious code on the server. Any attempt to circumvent your storage and/or bandwidth restrictions. Sending spam (unsolicited email) from your account. Any other activity deemed to be intentional attempts to hack any system of ours.
	Data backup
	We will do our best to preserve your data. Your files are stored on RAID 5 arrays. We may also make backups of your data but do not guarantee data backups. We are not responsible for lost data. We will only attempt to restore data from backups if we experience a catastrophic failure of our system.

You agree to indemnify and hold Seattle Web Development & Consulting, LLC, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of any information or data you post on Seattle Web Development & Consulting, LLC your use of Seattle Web Development & Consulting, LLC web hosting services, your violation of these Terms and Conditions, or your violation of any rights of another.
